  23. This set of norms is issued by the National Governance Committee of New Generation Artificial Intelligence, and it is responsible for explaining and guiding its implementation.   24. With actual requirements and needs, management departments at all levels, enterprises, universities, research institutes, associations and other related organizations may formulate more specific ethical norms and related measures based on this set of norms.   25. This set of norms shall be carried out starting from the date of its publication, and shall be revised in due course according to the needs of economic and social development and the development state of AI.

Taking into consideration the principles above, the 40th International Conference of Data Protection and Privacy Commissioners calls for common governance principles on artificial intelligence to be established, fostering concerted international efforts in this field, in order to ensure that its development and use take place in accordance with ethics and human values, and respect human dignity. These common governance principles must be able to tackle the challenges raised by the rapid evolutions of artificial intelligence technologies, on the basis of a multi stakeholder approach in order to address all cross sectoral issues at stake. They must take place at an international level since the development of artificial intelligence is a trans border phenomenon and may affect all humanity. The Conference should be involved in this international effort, working with and supporting general and sectoral authorities in other fields such as competition, market and consumer regulation.

· 2. MECHANISM OF ACCESSION AND IMPLEMENTATION OF THE CODE

2.1 Voluntary Accession. Joining the Code is voluntary. By joining the Code, AI Actors agree to follow its recommendations. Joining and following the provisions of this Code may be taken into account when providing support measures or in interactions with an AI Actor or between AI Actors. 2.2 Ethics officers and or ethics commissions. To ensure the implementation of the provisions of this Code and the current legal norms when creating, applying and using an AIS, AI Actors appoint officers on AI ethics who are responsible for the implementation of the Code and who act as contacts for AI Actors on ethical issues involving AI. These officers can create collegial industry bodies in the form of internal ethics commissions in the field of AI to consider the most relevant or controversial issues in the field of AI ethics. AI Actors are encouraged to identify an AI ethics officer whenever possible upon accession to this Code or within two months from the date of accession to the Code. 2.3. Commission for the Implementation of the National Code in AI Ethics. In order to implement the Code, a commission for the implementation of the Code in the field of AI ethics (hereinafter referred to as the Commission) being established. The commission may have working bodies and groups consisting of representatives of the business community, science, government agencies and other stakeholders. The Commission considers the applications of AI Actors wishing to join the Code and follow its provisions; it also maintains a register of Code members. The activities of the Commission and the conduct of its secretariat are carried out by the Alliance for Artificial Intelligence association with the participation of other interested organizations. 2.4. Register of Code participants. To accede to this Code, the AI Actor sends a corresponding application to the Commission. The register of AI Actors who have joined the Code is maintained on a public website portal. 2.5. Development of methods and guidelines. For the implementation of the Code, it is recommended to develop methods, guidelines, checklists and other methodological materials to ensure the most effective observance of the provisions of the Code by the AI Actors 2.6. Code of Practice. For the timely exchange of best practices, the useful and safe application of AIS built on the basic principles of this Code, increasing the transparency of developers' activities, and maintaining healthy competition in the AIS market, AI Actors may create a set of best and or worst practices for solving emerging ethical issues in the AI life cycle, selected according to the criteria established by the professional community. Public access to this code of practice should be provided.

Commission for AI Ethics Code. A Commission for AI Ethics Code (hereinafter referred to as the Commission) is established in order to fulfill the Code. The Commission may have working bodies and groups consisting of the representatives of the business community, science, government agencies and other interested organizations. The Commission considers applications made by AI Actors willing to join the Code, and maintains the Register of AI Actors who joined the Code. The functioning of the Commission and its secretariat is administered by the ________________ with the participation of other interested organizations. 2.4. Register of the Code participants. An AI Actor shall send a corresponding application to the Commission to join this Code. The Register of AI Actors who joined the Code is administered on a public website portal. 2.5. Development of methods and guidelines. It is encouraged for the implementation of the Code to develop methods, guidelines, checklists and other methodological materials that ensure more effective compliance with the provisions of the Code by AI Actors. 2.6. Set of Practices. In order to ensure timely exchange of best practices of useful and safe AI systems application built on the basic principles of this Code, increase the transparency of developers' activities and maintain healthy and fair competition on the AI systems market, AI Actors can create a set of best and or worst practical examples of how to solve emerging ethical issues in the AI life cycle and selected according to the criteria established by the professional community. Public access to this set of practices should be provided.

· Plan and Design:

1 When designing a transparent and trusted AI system, it is vital to ensure that stakeholders affected by AI systems are fully aware and informed of how outcomes are processed. They should further be given access to and an explanation of the rationale for decisions made by the AI technology in an understandable and contextual manner. Decisions should be traceable. AI system owners must define the level of transparency for different stakeholders on the technology based on data privacy, sensitivity, and authorization of the stakeholders. 2 The AI system should be designed to include an information section in the platform to give an overview of the AI model decisions as part of the overall transparency application of the technology. Information sharing as a sub principle should be adhered to with end users and stakeholders of the AI system upon request or open to the public, depending on the nature of the AI system and target market. The model should establish a process mechanism to log and address issues and complaints that arise to be able to resolve them in a transparent and explainable manner. Prepare Input Data: 1 The data sets and the processes that yield the AI system’s decision should be documented to the best possible standard to allow for traceability and an increase in transparency. 2 The data sets should be assessed in the context of their accuracy, suitability, validity, and source. This has a direct effect on the training and implementation of these systems since the criteria for the data’s organization, and structuring must be transparent and explainable in their acquisition and collection adhering to data privacy regulations and intellectual property standards and controls.

· Multi stakeholder and adaptive governance and collaboration

46. International law and national sovereignty must be respected in the use of data. That means that States, complying with international law, can regulate the data generated within or passing through their territories, and take measures towards effective regulation of data, including data protection, based on respect for the right to privacy in accordance with international law and other human rights norms and standards. 47. Participation of different stakeholders throughout the AI system life cycle is necessary for inclusive approaches to AI governance, enabling the benefits to be shared by all, and to contribute to sustainable development. Stakeholders include but are not limited to governments, intergovernmental organizations, the technical community, civil society, researchers and academia, media, education, policy makers, private sector companies, human rights institutions and equality bodies, anti discrimination monitoring bodies, and groups for youth and children. The adoption of open standards and interoperability to facilitate collaboration should be in place. Measures should be adopted to take into account shifts in technologies, the emergence of new groups of stakeholders, and to allow for meaningful participation by marginalized groups, communities and individuals and, where relevant, in the case of Indigenous Peoples, respect for the self governance of their data.
